Terms of Service
Last updated: October 27, 2026
Who we are and what these terms cover
After Hours Virtual Receptionist ("we," "us," the "service") is operated by Odd Owl, LLC, a Delaware limited liability company. These terms are an agreement between us and the business that signs up for the service ("you"). By creating an account, starting a trial, or paying for a plan, you agree to these terms and to our Privacy Policy and SMS Terms. Questions? Email info@afterhoursvirtualreceptionist.com or call (832) 979-5957.
The service
We provide an AI phone receptionist that answers calls to your forwarded number, takes messages, captures caller details, and can book appointments and send related texts and emails. The receptionist is artificial intelligence, not a human. It is designed to answer immediately and to handle multiple simultaneous calls, but like any phone or software system it can be affected by outages, carrier issues, or caller behavior. We do not promise that every call will be answered or that every answer will be perfect. You can review call recordings and transcripts in your dashboard and tell us to correct anything the AI gets wrong.
Not for emergencies
The service is not a substitute for emergency services and cannot place 911 calls. Callers with emergencies are directed to hang up and dial 911. Do not use the service as an emergency line or a safety monitoring system.
No professional advice
The AI receptionist takes messages and books appointments. It does not give medical, legal, financial, or technical advice, and it does not diagnose problems over the phone. Anything it says to a caller is not professional advice from you or from us.
Free trial
New accounts start with a 14-day free trial. No card is needed to start. The trial includes 30 minutes of AI talk time; after those minutes are used, and when the trial ends, the receptionist switches to free message-taking mode. Nothing is charged during the trial. To continue full service, add a payment method and pick a plan; billing starts that day. You can activate early from the dashboard at any time.
Plans, minutes, and billing
Plans start at $99 per month and include 250 minutes of AI talk time per billing cycle. Time beyond the included minutes is billed at the published overage rate (currently $2 per minute), up to a monthly overage cap (currently $200). When the cap is reached, the receptionist switches to free message-taking mode for the rest of the cycle, so your bill cannot run away. Current plan details and rates are on the pricing page.
Subscriptions and add-ons are billed through Stripe to the card on file and renew automatically each cycle until canceled. Included minutes do not roll over. If a payment fails, we retry it; while a bill is unpaid the service may switch to free message-taking mode. We may change prices or plan contents with at least 30 days notice by email; changes do not apply mid-cycle.
Refunds and cancellation
If you are not satisfied in your first 30 days on a paid plan, email us and we will refund that first payment. After that, payments are not refundable, but you can cancel any time from the dashboard or by email and the service stays active through the end of the period you already paid for. We do not charge cancellation fees.
Your account and your responsibilities
You must give accurate signup information, keep your login credentials safe, and have the right to forward the phone number you connect. You are responsible for what happens under your account and for the instructions, greetings, and business facts you give the receptionist. You agree to use the service only for lawful business purposes.
Calls answered by the service are recorded and transcribed so you can review them. You are responsible for complying with the call recording and telemarketing laws that apply to your business and your callers, including any required notices or consents in your state. Text messages sent through the service must follow our SMS Terms and honor opt-outs.
Acceptable use
You may not use the service to break the law, to harass or defraud anyone, to send spam, to impersonate another business, to handle emergency dispatch, or to probe or disrupt our systems. We may suspend or end accounts that do.
Health information
We are not a HIPAA business associate and the service is not designed to store or protect protected health information. If your business is covered by HIPAA, do not route calls that involve protected health information through the service. See security and compliance for details.
Your data and our software
Your business information, caller details, recordings, and transcripts belong to you. You give us permission to process them to run the service, as described in the Privacy Policy. The software, the website, and the service itself belong to us and our licensors. Phone numbers we provision for the service remain ours and may be reclaimed when an account closes.
Service changes and availability
We improve the service often and may add, change, or retire features. We work to keep the service available around the clock, and we publish live component health on our status page, but we do not promise uninterrupted or error-free operation.
Disclaimers and limits on liability
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost leads, or lost business, even if we were told they were possible. Our total liability for any claim related to the service is limited to the amounts you paid us in the three months before the event giving rise to the claim. Some states do not allow certain limits, so parts of this section may not apply to you.
Termination
You can close your account at any time. We can suspend or close an account that violates these terms, creates legal risk, or goes unpaid. When an account closes, call forwarding to your service number stops working, so update your forwarding first. You can request an export of your data within 30 days of closing.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Before filing any claim, you agree to contact us first so we can try to resolve the issue informally.
Changes to these terms
We will post updates to these terms on this page with a new date. If a change meaningfully reduces your rights, we will email the account owner before it takes effect. Using the service after a change takes effect means you accept the updated terms.
